If the custodial mother remarries, her custody will not be lost in three cases:

• The father must be rich or able to earn a living.

 

1- The marriage contract must be valid.

2- The detention is achieved for the benefit of the husband or the preparation for detention, even if it is not achieved for a reason not caused by the wife.

 

 

Yes, a woman who has custody of her children and does not have any proof of that can obtain a termination of custody without filing a lawsuit according to Circular No. (1049/T) dated 06/20/1439 AH, but on the condition that there is no dispute over custody and that there is no disputed custody lawsuit.

 

Custody is not transferred or dropped in this case due to the change in time and its development from the previous time and the availability of modern means of transportation and communication.
